Spotify's web player exploited by Chrome extension to download songs as MP3s

This is why we can't have nice things. Spotify's web player has been rolling out to more users since its closed beta launch late last year, but today an extension popped up in the Google Chrome store (it's already been pulled) allowing users to download songs as MP3 files. According to the notes left by its author, the company wasn't using any encryption on its HTML5 player, making it a pretty simple project to put together. We're waiting to hear back from Spotify about the breach, and while Google appears to have been quick on the ball to remove the extension -- in a similar manner to how it's treated YouTube download tools in the Chrome Web Store -- hopefully this won't give others pause on distributing premium content using HTML5.

France confirms 1st case of new SARS-related virus

PARIS (AP) ? A 65-year-old Frenchman is hospitalized after contracting France's first case of a deadly new respiratory virus related to SARS, and French health authorities said Wednesday they are trying to find anyone who might have been in contact with him to prevent it from spreading.

It's unclear how or where the man was infected with the novel coronavirus, which has killed 18 people and raised new public health concerns since being identified last year in the Middle East. It can cause acute pneumonia and kidney failure.

The patient fell ill after returning from a nine-day vacation in Dubai in the United Arab Emirates as part of a package tour, the Health Ministry said. Jean-Yves Grall, the French government health director, said the patient is in "worrying condition" under isolation and medical surveillance, receiving respiratory assistance and blood transfusions.

The man, whose identity was not released, returned from Dubai on April 17. He was hospitalized with respiratory problems in the northern French city of Valenciennes on April 23, and transferred to a more advanced facility in Douai on April 29, Grall told a news conference Wednesday.

Paris' Pasteur Institute analyzed the man's virus and confirmed Tuesday that it is a novel coronavirus.

Since September 2012, the World Health Organization has been informed of 30 confirmed cases of the virus, and 18 of the patients have died. Cases have emerged in Saudi Arabia, Jordan, the UAE, Qatar, Britain and Germany, and health officials say the virus has likely already spread from person to person in some circumstances.

Since the virus emerged last year, European authorities have put in place monitoring measures. In France, 20 people were examined for suspected cases of the virus, and the other 19 turned up negative, Health Minister Marisol Touraine said.

The patient who traveled to Dubai is the only positive case. His family members have been tested and are not infected, the Health Ministry said, and the other travelers in his tour group and health care workers who had contact with him are also being tested.

Authorities are trying to reach anyone else who was in contact with the patient before he was hospitalized, and a national hotline was established Wednesday for the public to call about the virus.

WHO has advised countries to test any people with unexplained pneumonia.

"Any virus that has the potential to develop into something that is highly transmissible between people, including the coronavirus, is a major concern," WHO spokesman Gregory Hartl said.

"We need to follow up on all possible routes of infection, i.e. animal to human, whether it's being spread in hospitals or from human-to-human," he said.

Health authorities are trying to determine how humans are contracting and spreading the virus and how best to treat it. It does not appear to be as contagious as SARS or the flu, but it seems to have spread among family members in Britain and in health workers in Jordan who were caring for patients, for example.

The new coronavirus is most closely related to a bat virus and scientists are considering whether bats or other animals like goats or camels are a possible source of infection.

Hartl said it's unclear whether there is something specific in the environment in the Middle Eastern countries where cases have been confirmed.

SARS, or severe acute respiratory syndrome, killed some 800 people in a 2003 epidemic.

Judge seals documents in sexual harassment lawsuit against ...

BIRMINGHAM, Alabama -- Documents placed under seal today by a federal judge in a sexual harassment case against Birmingham Health Care and its former CEO Jonathan Dunning purport to show Dunning lending his former employer $1.3 million at 10 percent interest.

According to the documents, among about a dozen ordered sealed, the money was used in 2011 to help BHC to pay its bills, which included more than $600,000 owed to Dunning's companies for rent and other services.

In asking that the documents be thrown out, lawyers for Dunning and BHC on Friday called them "inadmissible, irrelevant, impertinent, and confidential/proprietary."

Today, U.S. Magistrate Judge John E. Ott ordered the documents sealed pending a response from former BHC employee Sharon Waltz who filed the sexual harassment suit.

"None of these documents has been properly authenticated and some of them constitute hearsay," said the court filing by Ken Dowdy, representing Birmingham Health Care, and Carter Dukes, representing Dunning.

Waltz filed suit against Dunning and BHC on Feb. 14, alleging Dunning forced her to have sex with him on the condition of keeping her job. Waltz worked for Dunning at BHC until about 2009 as a grant writer and continued to work for Dunning at Synergy Medical Solutions, one of Dunning's companies, until last year. Dunning was CEO of BHC for about a decade until 2008.

The fight over these recently filed documents came out of a series of legal exchanges which started when Dunning and BHC filed a motion to have the lawsuit dismissed.

In that court filing April 10, Dunning and BHC said that the allegations filed under Title VII, the Civil Rights Act, of 1964, don't apply to individuals, thus Dunning cannot be held liable.

The filing also contended that BHC was not named in the original Equal Employment Opportunity Commission complaint - that only Dunning and the Synergy Medical Solution were named. To be sued, BHC would have to have been named in the EEOC complaint, BHC argued.

Waltz responded April 25 that she did name BHC in the EEOC filing, and that Synergy, Dunning and BHC are so inter-connected as to be one entity anyway.

In support of that April 25 contention that Synergy, BHC and Dunning "are one and the same," Waltz attorney Bill Bright entered nearly two dozen exhibits, including contracts, state incorporation records and rental agreements, among other items.

Among the documents was an unsigned agreement for a promissory note, setting up a line of credit, with Dunning as the lender and BHC as the borrower of $1.3 million.? According to the promissory note dated February, 2011, the money would have to be repaid with interest on Dec. 31, 2012.

"In essence, Dunning was now personally paying for BHC and controlling BHC for his pleasure," Waltz's filing said, regarding the promissory note and line of credit.

A related document, also under seal, is an accounting by the BHC chief financial officer of more than 100 bills paid, at least in part, by a line of credit, according to the Waltz filing. The initial page of that document is titled "Recap of Line of Credit" and contains a line item "BHC deposits transferred to credit lines" for $1,273,384.40.

A page in this document marked "What BHC Owes" lists $480,000 in unpaid rent for space in two buildings owned by a Dunning company. BHC rents space at the South Plaza for $30,000 per month; and rents space at North Plaza or Norwood (where Synergy is headquartered) for $18,000 per month, according to the document. The document also lists about $200,000 in other bills from companies owned by Dunning.

Dunning and BHC argue that Waltz's attempt to connect Synergy and BHC falls out of the scope of the original complaint, in which she "does not even mention Synergy, much less allege a relationship between BHC and Synergy."

"Because the complaint does not plausibly allege any relationship between BHC and Synergy, there is no factual basis upon which this court can excuse plaintiff's failure to exhaust administrative remedies against BHC," it stated.

(AP) ? The Senate sided with traditional retailers and financially strapped state and local governments Monday by passing a bill that would widely subject online shopping ? for many a largely tax-free frontier ? to state sales taxes.

The Senate passed the bill by a vote of 69 to 27, getting support from Republicans and Democrats alike. But opposition from some conservatives who view it as a tax increase will make it a tougher sell in the House. President Barack Obama has conveyed his support for the measure.

Under current law, states can only require retailers to collect sales taxes if the store has a physical presence in the state.

That means big retailers with stores all over the country like Wal-Mart, Best Buy and Target collect sales taxes when they sell goods over the Internet. But online retailers like eBay and Amazon don't have to collect sales taxes, except in states where they have offices or distribution centers.

As a result, many online sales are tax-free, giving Internet retailers an advantage over brick-and-mortar stores.

"We ought to have a structure in place in the states that treats all retail the same," said Matthew Shay, president and CEO of the National Retail Federation. "Small retailers are collecting (sales tax) on the first dollar of any sale they make, and it's only fair that other retailers who are selling to those same customers the same product have those same obligations."

The bill would empower states to require businesses to collect taxes for products they sell on the Internet, in catalogs and through radio and TV ads. Under the legislation, the sales taxes would be sent to the state where the shopper lives.

Supporters say the current tax disparity is turning some traditional stores into showrooms, where shoppers pick out items they like, then buy them on the Internet to avoid sales taxes.

"It's about the way commerce has changed in America," said Sen. Dick Durbin, D-Ill. "Bookstores, stores that sell running shoes, bicycles and appliances are at a distinct disadvantage. They've become showrooms."

Internet giant eBay is leading the fight against the bill, along with lawmakers from states with no sales tax and several prominent anti-tax groups. The bill's opponents say it would put an expensive obligation on small businesses because they are not as equipped as national merchandisers to collect and remit sales taxes at the multitude of state rates.

"Giant retailers have a requirement to collect sales taxes nationwide because they have physical presence nationwide," eBay president John Donahoe wrote in an online column over the weekend. "Likewise, today small retail stores and online retailers collect sales taxes for the one state where they are located. That's a fair requirement."

"If the bill passes, small online businesses would have the same tax compliance obligations and face the same enforcement risks as giant retailers, despite the fact that they are usually located in just one state."

Businesses with less than $1 million in online sales would be exempt. EBay wants to exempt businesses with up to $10 million in sales or fewer than 50 employees.

Some states have sales taxes as high as 7 percent, plus city and county taxes that can push the combined rate even higher. For example, the combined state and local sales tax is 9 percent in Los Angeles and 9.25 percent in Chicago. In New York City, it's 8.5 percent and in Richmond, Va., 5 percent. In many states, shoppers are already required to pay unpaid sales tax when they file their state income tax returns. However, states complain that few taxpayers comply.

Many governors ? Republicans and Democrats ? have been lobbying the federal government for years for the authority to collect sales taxes from online sales.

The issue is getting bigger for states as more people make purchases online. Last year, Internet sales in the U.S. totaled $226 billion, up nearly 16 percent from the previous year, according to government estimates.

States lost a total of $23 billion last year because they couldn't collect taxes on out-of-state sales, according to a study done for the National Conference of State Legislatures, which has lobbied for the bill. About half of that was lost from Internet sales; half from purchases made through catalogs, mail orders and telephone orders, the study said.

Supporters say the bill makes it relatively easy for Internet retailers to comply. States must provide free computer software to help retailers calculate sales taxes, based on where shoppers live. States must also establish a single entity to receive Internet sales tax revenue, so retailers don't have to send it to individual counties or cities.

Opponents worry the bill would give states too much power to reach across state lines to enforce their tax laws. States could audit out-of-state businesses, impose liens on their property and, ultimately, sue them in state court.

In the Senate, lawmakers from three states without sales taxes are leading the opposition: Montana, New Hampshire and Oregon. They argue that businesses based in their states should not have to collect taxes for other states.

Delaware also has no sales tax, though Delaware's two senators support the bill.

Grover Norquist, an anti-tax advocate, and the conservative Heritage Foundation oppose the bill, and many Republicans have been wary of crossing them.

Even so, the issue has a bipartisan flavor. The main sponsor, Sen. Mike Enzi, is a conservative Republican from Wyoming. He has worked closely with Durbin, a liberal Democrat.

In the House, Republican Speaker John Boehner has not commented publicly about the bill, giving supporters hope that he could be won over.

Rep. Bob Goodlatte, R-Va., chairman of the House Judiciary Committee, which would have jurisdiction over the bill, has cited problems with the legislation but has not rejected it outright.

"While it attempts to make tax collection simpler, it still has a long way to go," Goodlatte said in a statement. Without more uniformity in the bill, he said, "businesses would still be forced to wade through potentially hundreds of tax rates and a host of different tax codes and definitions."

Goodlatte said he's "open to considering legislation concerning this topic but these issues, along with others, would certainly have to be addressed."

Clearwire says Sprint offer best option for minority stockholders

(Reuters) - Wireless service provider Clearwire Corp said on Monday its proposed buyout by majority owner Sprint Nextel Corp was the best option for Clearwire's minority stockholders.

Clearwire shares, which fell about 6 percent in an initial reaction to the statement, recovered to trade just above the closing price of $3.38 on Friday.

"The Clearwire board has unanimously concluded that the proposed transaction with Sprint is the best strategic alternative for stockholders ... especially in light of the company's limited alternatives and the well-known constraints of its liquidity position," Clearwire said.

Four shareholders holding about 17 percent of Clearwire's shares said on Friday they would work together to seek a better deal for the wireless service provider.

Sprint offered to buy Clearwire in December for $2.2 billion but satellite TV provider Dish Network Corp announced a counterbid of $2.3 billion in January. Dish followed up in April by making a bid for Sprint.

Clearwire said in February it would evaluate Dish's bid but continued to recommend Sprint's offer.
